“We are planning to film a documentary outside the United States, does our liability policy cover us?” Most US policies include limited worldwide coverage. So for your policy to provide defense and indemnity, the claim must be filed against you in the States. If the alleged injured party files outside the US, you are likely to bear all the expenses yourself. Additionally, in some countries, such as Mexico, you can actually be jailed for not having local coverage. It’s always best to obtain foreign coverage to protect you, your employees and your property.
“We rented a camera to a production company and they failed to return it. Does their policy cover our loss?” No. All insurance policies have an exclusion for fraud. In order to be covered, your policy must be endorsed to allow for the risk of conversion. If you’re not sure, don’t wait until the claim happens. Have your equipment policy reviewed before it’s too late.
