“Are the events we host covered under our Aviation Hull and Liability Policy?”

Unfortunately not. The product liability coverage under this policy does not include claims that are not directly involved with the aircraft. So in the event of widespread injury or food poisoning, for example, you would face a potentially huge loss. You need special events coverage.

“We run a jet management company. What happens if an accident occurs involving one of our clients’ jets – and their insurance carrier refuses to defend or indemnify us?”

This situation has happened, so you need to guard against this. At the time of a loss, negligence is a major factor in deciding if an additional insured has coverage and you may not be listed as an additional insured on the owner’s Aviation Policy. If either occurs, you’re not covered by that policy. So make sure your fleet program covers all aircraft operating under your Part 135 certificate. You’re the first named insured on that policy – and you’re covered!

Entertainment Insurance

“We are planning to film a documentary outside the United States, does our liability policy cover us?”

Most US policies include limited worldwide coverage. So for your policy to provide defense and indemnity, the claim must be filed against you in the States. If the alleged injured party files outside the US, you are likely to bear all the expenses yourself. Additionally, in some countries, such as Mexico, you can actually be jailed for not having local coverage. It’s always best to obtain foreign coverage to protect you, your employees and your property.

“We rented a camera to a production company and they failed to return it. Does their policy cover our loss?”

No. All insurance policies have an exclusion for fraud. In order to be covered, your policy must be endorsed to allow for the risk of conversion. If you’re not sure, don’t wait until the claim happens. Have your equipment policy reviewed before it’s too late.

Commercial

“I own a company that is growing rapidly. As I interview increasing numbers of people for positions, I’m worried that some of those candidates may sue for discrimination. Would our General Liability Policy cover me?”

It would not. In order to protect your business from claims alleging wrongful termination, sexual harassment or discrimination, you should also have an Employment Practices Liability Policy.

Personal

“I’m single and have no dependents. Do I really need disability insurance?”

You should consider it carefully. Your income is probably your largest asset; disability insurance is one way to protect it. A surprising number of Americans experience some form of long or short term disability that prevents them from working. Also, a significant number of home defaults – up to 40% by some estimates – occurs because of disability. For many people Disability Insurance is a must.
